PHOENIX OPEN and Shut Dispute?

Print

This is a strange fact pattern. Plaintiff alleges that it has operated the PGA event, the PHOENIX OPEN (now known as the Waste Management Phoenix Open) for decades. Defendant approaches plaintiff and alleges that it owns the rights to PHOENIX OPEN. I couldn’t find any press reports on the dispute. Something is not right with this picture.

There are a lot of “[Place Name] Open” tournaments in various sports, so perhaps the trademark rights are relatively weak in any one of them unless it’s extremely famous.

On a different subject, I can’t stand the trend of corporate naming of events… in this case they’re sticking the name of a trash-hauling company on the tournament, which really stinks!
